Website Terms & Conditions
Effective Date: 09/20/2026 • Last Updated: 10/03/2026
These Terms and Conditions ("Terms") govern your use of ScendPsychiatricServices.com (the "Site"), operated by Scend Psychiatric Services Nursing Corporation ("Provider," "we," "us"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site. You may accept these Terms electronically, and an electronic record or signature has the same legal effect as a paper one (Civil Code § 1633.7).

Where a particular feature, transaction, or service requires affirmative consent to terms, disclosures, or authorizations, Provider will present those terms, disclosures, or authorizations and obtain the consent required by applicable law before the applicable transaction or service is completed.

1. No Provider-Patient Relationship Formed by Site Use
Use of the Site, including submitting a contact form, appointment request, or email inquiry, does not by itself create a provider-patient relationship. A provider-patient relationship begins only after Provider has completed its intake process, confirmed availability and fit, and both parties have agreed to begin services, evidenced by signed consent and intake documentation.

Nothing in these Terms alters any rights, duties, standards of care, confidentiality obligations, informed-consent requirements, or other requirements that apply to professional services under applicable law once a provider-patient relationship has been established.

2. No Obligation to Accept Appointment Requests
Submission of a contact form, appointment request, inquiry, or other communication through the Site does not guarantee that Provider will respond, accept the request, schedule an appointment, or provide services. Provider may decline a request for services or determine that services are not appropriate based on availability, clinical considerations, licensure requirements, applicable law, Provider policies, or other legitimate considerations.

3. Not a Substitute for Professional Care or Emergency Services
The Site and its content are provided for general informational purposes only and are not a substitute for professional diagnosis, treatment, or advice. The Site is not monitored for emergencies.

See our Disclaimer, available here, for additional information regarding the Site and emergency or crisis situations. The Site is not monitored for emergencies. Do not use the Site, contact forms, email, or appointment-request functionality to seek emergency assistance. If you are in crisis, call 911 or call or text 988 (the Suicide & Crisis Lifeline), or chat at 988lifeline.org.

4. No Reliance on Website Communications
Information, communications, responses, or materials provided through the Site are not individualized medical, psychiatric, therapeutic, diagnostic, or treatment advice unless expressly provided as part of an established professional relationship. A response to an inquiry, appointment request, email, or other Site communication does not establish a therapist-client relationship or create an obligation to provide professional services.

5. Permitted Use of the Site
You may use the Site for lawful, personal, non-commercial purposes related to learning about Provider's services and requesting an appointment. You agree not to:
-
Use the Site in any way that violates applicable law or these Terms;
-
Attempt to gain unauthorized access to the Site, its systems, or related networks;
-
Use automated means (bots, scrapers, or similar tools) to access or collect data from the Site without our prior written consent;
-
Transmit any viruses, malware, or other harmful code through the Site;
-
Impersonate any person or entity, or misrepresent your affiliation with any person or entity, in connection with the Site.
Â
You must not use the Site to submit information that is false, fraudulent, or intentionally misleading, or to impersonate another person. You must not use the Site to interfere with the provision of services to another person or to circumvent any applicable intake, identity-verification, consent, or eligibility requirement.

6. User-Submitted Information
You are responsible for ensuring that information you submit through the Site is accurate and not intentionally misleading. You must not submit confidential, sensitive, or protected health information through general Site forms, email, or other channels unless Provider expressly identifies the applicable channel as appropriate for that information.

Provider may rely on information you provide through the Site for purposes of responding to inquiries, processing requests, administering Site functions, and taking other actions permitted by applicable law. Provider is not responsible for consequences resulting from inaccurate, incomplete, or misleading information supplied by you, except to the extent otherwise required by applicable law.

7. Intellectual Property
All content on the Site, including text, graphics, logos, and images, is owned by or licensed to Provider and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written permission, except for personal, non-commercial reference.

8. Site Content and Availability
Provider may modify, update, remove, or discontinue Site content, features, services, or functionality at any time. Information concerning Provider's services, clinicians, availability, fees, insurance participation, or other matters may change without notice. Nothing displayed on the Site constitutes a guarantee that any particular service, clinician, appointment, treatment, medication, or other resource will be available to you.

9. Third-Party Links and Services
The Site may contain links to, or integrate with, third-party websites and services, including scheduling, payment, communications, or client-portal services. Third-party services may be subject to their own terms and privacy practices. Provider does not control those third-party services.

Where a third-party service processes personal information on Provider's behalf, Provider's handling of that information remains subject to Provider's applicable Privacy Policy and other applicable legal requirements. Nothing in these Terms is intended to disclaim any responsibility that Provider cannot lawfully disclaim.

Provider may rely on third-party providers to support Site functions, including scheduling, payment processing, communications, hosting, security, analytics, and client-portal functionality. Provider does not guarantee the availability, security, accuracy, or uninterrupted operation of third-party services and is not responsible for failures or acts or omissions of third parties except to the extent liability cannot lawfully be excluded or limited.

10. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Nothing in this Section excludes, restricts, or limits any warranty, right, remedy, or obligation that cannot lawfully be excluded, restricted, or limited.

11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SCEND PSYCHIATRIC SERVICES NURSING CORPORATION AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE.

THIS LIMITATION APPLIES ONLY TO CLAIMS ARISING FROM THE SITE AND DOES NOT APPLY TO CLAIMS ARISING FROM PROFESSIONAL SERVICES PROVIDED WITHIN AN ESTABLISHED PROVIDER-PATIENT RELATIONSHIP, WHICH ARE GOVERNED BY THE APPLICABLE PROFESSIONAL RELATIONSHIP, INFORMED CONSENT, AND PROFESSIONAL STANDARDS.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY TO THE EXTENT SUCH EXCLUSION OR LIMITATION IS PROHIBITED BY APPLICABLE LAW. CALIFORNIA LAW DOES NOT ALLOW A PARTY TO EXEMPT ITSELF FROM RESPONSIBILITY FOR ITS OWN FRAUD, WILLFUL INJURY, OR VIOLATION OF LAW (CIVIL CODE § 1668), AND THESE TERMS DO NOT DO SO.

12. Indemnification
To the extent permitted by applicable law, you are responsible for losses, damages, liabilities, and reasonable costs arising directly from your unlawful use of the Site or your material violation of these Terms. Nothing in this Section requires you to indemnify Provider to the extent the claim results from Provider's own negligence, willful misconduct, or violation of applicable law.

13. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles, except to the extent applicable law requires application of another jurisdiction's law. Any dispute arising from these Terms or your use of the Site will be brought in a court of competent jurisdiction located in San Diego County, California, subject to any applicable law that provides otherwise. If you are a patient of Provider, any dispute between you and Provider is governed by the separate [Dispute Resolution Agreement] that you are asked to review and sign separately. Accepting these Terms or using the Site does not by itself waive any right to a court or jury, and the terms of that separate agreement control dispute resolution for patients. California law continues to govern these Terms.

14. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date identifies the date of the most recent update.

For material changes, we will provide any notice required by applicable law. Where appropriate, we may also provide notice by posting a notice on the Site or, for users with an account, by email to the email address associated with the account.

Unless a different effective date is required or stated, updated Terms become effective when posted. If you do not agree to updated Terms, you must stop using the Site.

Nothing in this Section changes or overrides any separate notice, consent, or amendment requirements applicable to a particular transaction or service.

15. Contact Us
Questions about these Terms may be directed to Contact@ScendPsychiatricServices.com or by phone at 858-769-9664. Provider’s Disclaimer and Privacy Policy are separate documents that apply to your use of the Site together with these Terms.

For legal notices, privacy requests, or other communications for which applicable law requires a particular method or address, use the method specified in the applicable notice or Privacy Policy.

16. Eligibility and Authority
You represent that you have legal capacity to agree to these Terms and that the information you provide to Provider through the Site is accurate to the extent necessary for the applicable transaction or request. The Site is not directed to children under 13 and is for adults. A minor should have a parent or guardian use the Site; clinical care for minors is arranged through Provider’s intake process and consent forms, not through the Site.

Where a person is acting on behalf of another individual, including a minor or an individual who requires a legally authorized representative, that person represents that they have the authority required by applicable law to act on that individual's behalf.
Â
17. Accounts and Portal Credentials
If the Site or a linked portal permits you to create an account, you are responsible for maintaining the confidentiality of your login credentials and for promptly notifying Provider of any suspected unauthorized access to or use of your account. You must not share credentials except as expressly permitted by the applicable portal or service.

Provider may require reasonable account-security measures and may suspend access when reasonably necessary to address a security threat, unauthorized access, or legal requirement.

18. Suspension and Termination
Provider may suspend or terminate access to the Site or a particular Site feature when reasonably necessary to address a security threat, prevent unlawful or unauthorized use, comply with applicable law, or enforce these Terms. Where practicable, Provider will provide notice before taking such action; however, notice is not required where immediate action is reasonably necessary.

Termination or suspension of Site access does not terminate any rights or obligations that cannot, by their nature or under applicable law, be terminated.

19. Privacy
Provider's collection, use, disclosure, retention, and other processing of personal information are described in Provider's Privacy Policy at ScendPsychiatricServices.com/privacy-policy. The Privacy Policy is incorporated by reference solely for purposes of describing Provider's privacy practices and applicable privacy rights.

Where California or other applicable privacy law applies, Provider will provide the notices and rights required by that law through the Privacy Policy and applicable request mechanisms.

20. Privacy Requests
If applicable law provides you with rights concerning your personal information, including rights to access, delete, correct, or opt out of certain processing, you may exercise those rights using the methods described in the Privacy Policy. Provider will process requests in accordance with applicable law.

21. Account Deletion
If you have a Site account or portal account, you may request account deletion using the method described in the applicable portal or Privacy Policy. Account deletion does not require Provider to delete information that Provider is required or permitted to retain under applicable law.

22. Incorporated Policies; Supplemental Terms
The following documents are incorporated by reference only to the extent applicable to your use of the Site or applicable service:
-
Privacy Policy — ScendPsychiatricServices.com/privacy-policy
-
Disclaimer — ScendPsychiatricServices.com/disclaimer
Â
If supplemental terms expressly applicable to a particular service or transaction conflict with these Terms, those supplemental terms control solely with respect to that service or transaction. Nothing in these Terms or any supplemental terms waives or limits a right or protection that cannot lawfully be waived or limited.

23. Electronic Communications
Provider may communicate with you electronically where permitted by applicable law, including by email or through the applicable Site or portal. You are responsible for providing accurate contact information. Where applicable law requires separate consent to receive a particular disclosure, notice, or record electronically, Provider will obtain that consent in the manner required by law.

24. Effect of Termination
Upon termination of your access to the Site, your authorization to access and use the Site ends. Termination does not affect rights or obligations that accrued before termination or provisions that, under applicable law or their nature, are intended to continue.

25. Survival
Any provision of these Terms that by its nature or purpose should survive termination or cessation of your use of the Site will survive, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, governing law, privacy, and any accrued rights or obligations.
