Website Privacy Policy
Effective Date: 09/20/2026 • Last Updated: 10/03/2026
This Privacy Policy describes how Scend Psychiatric Services Nursing Corporation ("Provider," "we," "us") collects, uses, and shares information through ScendPsychiatricServices.com (the "Site").

This Policy applies only to information collected through the Site. It does not apply to protected health information ("PHI") created or received in the course of an established provider-patient relationship, which is instead governed by our HIPAA Notice of Privacy Practices, available at ScendPsychiatricServices.com or upon request.

Nothing in this Policy limits or replaces any rights or protections that apply to PHI or other health information under HIPAA, the California Confidentiality of Medical Information Act ("CMIA"), or other applicable law. Where another applicable law provides greater protection, that law controls to the extent required by law.

1. Information We Collect

Information You Provide
-
Contact and appointment request forms: name, email address, phone number, and any message or information you choose to include.
-
Newsletter or mailing list sign-ups, if offered.
-
Information you submit through a client portal, if the Site links to one operated by a third-party vendor
Â
The privacy practices applicable to a third-party portal are governed by the terms and privacy notices applicable to that portal and, where Provider is a covered entity or business associate and the information constitutes PHI, by applicable HIPAA requirements and Provider's NPP.

Information Collected Automatically
-
Device and usage data such as IP address, browser type, operating system, referring URLs, and pages viewed, collected through server logs and similar technologies.
-
Cookies and similar tracking technologies, as described in Section 2.
Â
Information From Other Sources
-
Information from third-party platforms you use to interact with us, such as social media pages, subject to that platform's own privacy practices.
Â
We may also receive information from service providers that operate functions on our behalf, such as website hosting, scheduling, communications, security, analytics, or form-processing services, to the extent permitted by applicable law.
Â
Information Submitted Through the Site
You are responsible for ensuring that information you submit through the Site is accurate and does not contain information about another person unless you are authorized to provide that information. You should not submit sensitive personal information or protected health information through general Site forms, email, or other unsecured channels unless the Site expressly identifies the applicable method as an appropriate secure channel.
Â
Provider may use information submitted through the Site to respond to your inquiry, provide requested administrative services, evaluate or process appointment requests, maintain Site functionality, and otherwise as permitted by this Policy and applicable law. Submission of information through the Site does not guarantee that Provider will accept you as a client, schedule an appointment, provide services, or respond to the submission.

2. Cookies and Tracking Technologies
The Site may use cookies, pixels, or similar technologies for functionality, analytics (e.g., Google Analytics), and, if enabled, advertising purposes.

You can control certain cookies through your browser settings and, where applicable, through any cookie-management or privacy controls that we make available on the Site. Disabling certain technologies may affect Site functionality.

Where required by applicable law, we will provide any legally required notice and choice mechanism before collecting personal information through cookies, pixels, or similar technologies.

Provider does not knowingly use advertising or analytics technologies on the Site in a manner that is inconsistent with applicable law. Where a tracking technology collects or derives information concerning a person's health, health-care interests, or attempts to obtain health care, Provider will use, disclose, and retain that information only as permitted by applicable law.

Provider does not use advertising or analytics pixels (including Meta Pixel or similar technologies) on webpages that describe specific health conditions or services.

3. How We Use Information
-
To respond to inquiries and appointment requests submitted through the Site.
-
To communicate with you regarding your inquiry or appointment request.
-
To operate, maintain, and improve the Site.
-
To administer forms, scheduling, communications, and other Site functionality.
-
To detect, prevent, and address fraud, security incidents, misuse, and technical problems.
-
To comply with legal obligations and protect the rights, safety, and property of Provider, Site visitors, and others.
-
To protect the rights, safety, and property of Provider, Site visitors, clients, and others.
Â
We use personal information only for the purposes reasonably necessary and proportionate to achieve the purposes for which it was collected or for other purposes permitted by applicable law.
We do not sell personal information collected through the Site for monetary consideration. We also do not use Site information for automated decision-making concerning a person's eligibility for treatment unless expressly permitted by applicable law and separately disclosed where required.

4. How We Share Information
-
Service providers who help operate the Site, such as web hosting, scheduling, email, and analytics vendors, under contractual confidentiality obligations.
-
As required by law, court order, or to protect the safety of any person.
-
In connection with a merger, acquisition, or sale of practice assets, subject to applicable confidentiality obligations.
Â
We do not disclose personal information collected through the Site to third parties for their own independent marketing purposes except with your consent or as otherwise permitted by applicable law.

For purposes of applicable California privacy law, the categories of third parties to whom we may disclose personal information include website and technology providers, scheduling and communications providers, analytics providers, professional advisers, governmental authorities, and parties to business transactions.

5. Relationship to HIPAA and Clinical Records
Once you become a client of Scend Psychiatric Services Nursing Corporation, the clinical information we create and maintain about your care (your "treatment record") is protected health information governed by HIPAA and our Notice of Privacy Practices, not by this Policy.

Not all information concerning a person who is a patient or prospective patient necessarily constitutes PHI. Information collected through the Site is governed by the law applicable to that information and by this Policy unless and until a different privacy notice or legal regime applies.

Information submitted through a general Site contact or appointment request form, before a clinical relationship is established, may not yet qualify as PHI and may instead be governed by this Policy and by applicable state consumer health data laws described in Section 6.

Nothing in this Section determines whether information is PHI. Whether information constitutes PHI depends on the applicable legal definitions and circumstances of collection, receipt, maintenance, or transmission.

6. California Privacy Rights
Â
California Consumer Privacy Act / California Privacy Rights
The California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively, the "CCPA"), provides certain California residents with rights concerning their personal information. The CCPA applies only to businesses that meet its statutory thresholds (generally, more than $25 million in annual gross revenue, buying, selling, or sharing the personal information of 100,000 or more California consumers or households, or earning 50% or more of annual revenue from selling or sharing personal information), and it exempts medical information governed by the Confidentiality of Medical Information Act and HIPAA (Civil Code §§ 1798.140(d), 1798.145(c)).

Categories of Personal Information Collected
During the preceding 12 months, Provider may have collected the following categories of personal information through the Site, depending on the particular Site functionality used:
-
Identifiers, such as name, email address, telephone number, IP address, or other similar identifiers.
-
Internet or other electronic network activity information, such as browsing history, search history, pages viewed, referring URLs, and interactions with the Site.
-
Geolocation information, if actually collected or reasonably inferred.
-
Inferences drawn from the information above, if Provider actually creates or receives such inferences.
-
Professional or employment-related information, if voluntarily submitted through a form.
-
Sensitive personal information, including information concerning a person's health, only to the extent such information is actually collected and is subject to the CCPA rather than an applicable exemption.
Â
Provider does not need to collect every category listed above. This list describes categories that may be collected through the Site.

Sources
Provider may collect personal information directly from you; automatically through your use of the Site; and from service providers or third-party platforms that interact with the Site, as described above.
Â
Purposes
Provider may collect and use the categories above for the purposes described in Section 3.

Sale and Sharing
We do not sell, and do not share for cross-context behavioral advertising, sensitive personal information collected through the Site.

Provider does not sell personal information collected through the Site for monetary consideration and does not share personal information collected through the Site for cross-context behavioral advertising, unless this Policy is amended and any legally required notice and opt-out mechanism is provided before such processing occurs.

California Consumer Rights
Subject to applicable exceptions and verification requirements, California residents may have the following rights, to the extent the CCPA applies to Provider, under the CCPA:
-
The right to know/access personal information collected about them and information concerning its collection, use, disclosure, sale, or sharing;
-
The right to delete personal information, subject to statutory exceptions;
-
The right to correct inaccurate personal information;
-
The right to opt out of the sale or sharing of personal information, where applicable;
-
The right to limit certain uses and disclosures of sensitive personal information, where applicable;
-
The right not to receive discriminatory treatment for exercising CCPA rights.
Â
The CCPA provides exceptions to these rights, including exemptions applicable to certain medical information and other information.

How to Submit a California Privacy Request
California residents may submit a privacy request by:
(1) emailing Contact@ScendPsychiatricServices.com; and
(2) calling 858-769-9664 .
Â
Provider may use an email address as its designated method to submit requests to know, rather than a toll-free telephone number, to the extent permitted by applicable law.

Provider may take reasonable steps to verify a request before fulfilling it. Provider will not require a California consumer to create an account solely to submit a request.

Where applicable, requests may be submitted through an authorized agent in accordance with applicable law.

California requires covered businesses to provide designated methods for privacy requests, and the CCPA generally provides a 45-day response period, subject to permitted extension.

California Notice at Collection
Provider will provide a California Notice at Collection at or before the point at which personal information is collected through the Site, including in connection with Site forms, as required by applicable law. The Notice at Collection will identify the categories of personal information collected and the purposes for which those categories are collected and used.

California regulations require the Notice at Collection to be available at or before collection; for online forms, it may be provided by a conspicuous link in close proximity to the fields or submission button.

7. State-Specific Privacy Laws
Privacy laws of other jurisdictions may apply to information collected through the Site depending on Provider's activities, the location of the consumer, the nature of the information collected, and applicable statutory thresholds or exemptions. Where a specific law applies to Provider, Provider will provide the notices and rights required by that law.

8. Children's Privacy
The Site is not directed to children under 13, and Provider does not knowingly collect personal information from children under 13 through the Site except as permitted by applicable law. This age limit applies only to the Site and is separate from the age at which a minor may consent to certain outpatient mental health care in California (12, under Family Code § 6924 and Health & Safety Code § 124260). We do not sell or share the personal information of consumers under 16 without the opt-in consent that the CCPA requires (Civil Code § 1798.120(c)).

Appointment requests or intake for minor clients are handled through our clinical intake process, not through general Site data collection, and are subject to the consent requirements described in our client intake and consent forms.

9. Data Security and Site Availability and Modification
We use reasonable administrative, technical, and physical safeguards designed to protect information collected through the Site. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

We maintain security measures appropriate to the nature of the information and the risks presented by its processing, subject to applicable law.

Provider uses reasonable safeguards designed to protect information collected through the Site, but no electronic transmission, storage system, website, or security measure can be guaranteed to be completely secure. You understand that information transmitted over the internet or through electronic communications may be subject to risks outside Provider's reasonable control, including interception, unauthorized access, system failure, or other security incidents. Provider will respond to qualifying security incidents in accordance with applicable law.

Provider may modify, suspend, restrict, or discontinue any portion of the Site, including particular features or functionality, at any time when reasonably necessary for maintenance, security, legal or regulatory compliance, operational reasons, or other legitimate business purposes. Provider does not guarantee that the Site or any particular feature will remain available or function without interruption.

Provider may also restrict access to the Site when reasonably necessary to address suspected misuse, unauthorized access, security threats, unlawful activity, or conduct that may interfere with the Site or the rights or safety of Provider, its clients, or others.

10. Data Retention
We retain each category of personal information for the period reasonably necessary and proportionate to achieve the purposes for which it was collected or for other purposes permitted by applicable law. Retention periods may vary depending on the nature of the information, the purpose for which it was collected, legal and regulatory requirements, dispute-resolution needs, security requirements, and applicable record-retention obligations.

Information submitted through the Site may be retained only for as long as Provider reasonably determines is necessary for the purposes described in this Policy, to comply with applicable legal or regulatory requirements, to resolve disputes, maintain security, or otherwise as permitted by applicable law. Provider is not required to retain information indefinitely or to preserve information submitted through the Site after the applicable retention period has expired, except where retention is required by law or otherwise reasonably necessary for a permitted purpose.

11. Your Choices and Privacy Rights
-
You may opt out of marketing or newsletter communications at any time using the unsubscribe link or by contacting us.
-
You may control cookies through your browser settings.
Â
Where applicable law gives you a right to access, correct, delete, obtain, restrict, or otherwise control your personal information, you may exercise that right using the applicable request method described in this Policy or the applicable state-specific privacy notice.

California Shine the Light. If you are a California resident, you may ask us once a year for a list of the categories of personal information we shared with other businesses for their direct marketing purposes in the prior calendar year, and the names of those businesses (Civil Code § 1798.83). We do not share personal information for third parties’ direct marketing. To ask, contact us using the information in Section 14.

See Section 6 for California-specific rights and request procedures.

12. Third-Party Links
The Site may link to third-party websites or services, such as a scheduling portal or payment processor, that are not operated by us. This Policy does not apply to those third-party sites, and we encourage you to review their privacy policies.

Provider is not responsible for the privacy practices of third-party websites or services that Provider does not control.

Where a third-party service processes information on Provider's behalf, Provider requires the service provider to process information consistently with applicable contractual and legal requirements.

Third-Party Platforms
When you access or use a third-party platform through a link, embedded feature, scheduling tool, payment service, patient portal, or other integration provided through the Site, that platform may collect, use, or process information subject to its own terms and privacy practices. Provider does not control the privacy or security practices of third parties that operate platforms independently of Provider. You should review the applicable third party's privacy notice before submitting information through that platform.

Where Provider uses a third-party service provider to process information on Provider's behalf, Provider will use reasonable measures appropriate to the circumstances and applicable law to require the service provider to handle information consistently with applicable contractual and legal requirements.

13. Changes to This Policy
We may update this Policy from time to time. For a material change, we will post a notice on the Site’s home page for at least 30 days. The "Last Updated" date at the top of this Policy reflects the most recent changes.

If we make material changes to this Policy, we will post the updated Policy on the Site and update the "Last Updated" date. Where applicable law requires additional notice, consent, or other action concerning a material change, we will provide that notice or obtain that consent as required by law.

Provider will update its CCPA privacy-policy disclosures at least as frequently as required by applicable law. We review this Policy at least once every 12 months.
